Abstract

Law 3/2021 regulating euthanasia does not exclude people with mental illness from this right and its current wording suggests that there will be few who meet the criteria for the provision of aid to die. However, it is possible that in the future it will be modified so that more people with mental illness can request and obtain aid in dying on the basis of mental suffering. This concept is problematic because it is difficult to separate from the symptoms of the disease itself, and it has proven difficult to address and operationalise in other countries.
